1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) govern your use of the website at midnightplumbing.com (“Site”) and the plumbing services provided by Midnight Plumbing LLC, a California-licensed plumbing contractor (License #1079649). By accessing the Site, requesting a service quote, scheduling an appointment, or using our services in any way, you agree to be bound by these Terms.

2. WEBSITE USE LICENSE

We grant you a limited, non-exclusive, revocable license to access and use our Site for lawful purposes only. You agree not to reproduce, duplicate, copy, or sell any content without written permission; attempt to reverse engineer the Site; harass or engage in illegal activity; upload viruses or malware; or interfere with the Site’s performance.

3. PLUMBING SERVICES TERMS

3.1 Service Requests and Quotes

All quotes are provided in good faith based on information you provide. Final pricing may vary based on actual conditions found upon arrival, hidden damage, additional work requested, or required permits and code compliance upgrades. We will inform you of any price changes before proceeding with work exceeding the original quote, except in genuine emergency situations where immediate action is necessary to prevent property damage or unsafe conditions.

3.2 Service Availability and Response Times

We operate 24/7 and strive to provide same-day service whenever possible. However, response times are not guaranteed and may vary based on demand, weather, traffic, technician availability, and service complexity. We serve Orange County and select areas of Los Angeles and Riverside counties. Service outside our primary service area may incur additional travel fees.

3.3 Payment Terms

Payment is due upon completion of service unless other arrangements are agreed to in writing. We accept cash, check, and credit cards. Late Payment: If payment is not made within 30 days of invoice, a late fee of 1.5% per month (or maximum rate permitted by law) will be applied. Accounts past due more than 30 days may be referred to a collection agency.

3.4 Cancellation and Rescheduling

You must notify us at least 24 hours in advance to cancel or reschedule non-emergency appointments. Cancellations with less than 24 hours notice or no-shows may result in a service call fee. Emergency calls cancelled after technician dispatch may incur a service or travel fee.

3.5 Scope of Work

Our services are limited to work outlined in our written estimate or work order. We are not responsible for pre-existing damage, water damage, mold, structural issues not caused by our work, damage to landscaping or property not caused by our negligence, or code violations by other contractors.

3.6 Customer Property and Access

By scheduling service, you grant us access to your property. You are responsible for ensuring the property is safe and free from hazards, and must disclose any security systems or aggressive animals. We are not responsible for damage to personal property unless caused by our negligence.

3.7 Warranty and Guarantees

We warrant that all work will be completed in a professional and workmanlike manner in accordance with industry standards and California plumbing codes. If you are not satisfied with our work, please contact us within 24 hours of service completion. We will assess and make reasonable corrections at no additional charge. This warranty does not cover normal wear and tear, damage from freezing, flooding, earthquakes, misuse, neglect, or work by other contractors.

4. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIDNIGHT PLUMBING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE AT ISSUE, OR ONE THOUSAND DOLLARS ($1,000), WHICHEVER IS LESS.

5. DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY SET FORTH IN SECTION 3.7, OUR SITE AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT OUR SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES.

6. INDEMNIFICATION

You agree to indemnify and hold harmless Midnight Plumbing from any claims, damages, or losses arising out of your breach of these Terms, your use of our Site in violation of law, your infringement of third-party rights, or your negligence or failure to disclose hazards on your property.

7. INTELLECTUAL PROPERTY RIGHTS

All content on our Site, including text, graphics, logos, and images, is the exclusive property of Midnight Plumbing LLC and is protected by copyright and intellectual property laws. You may not reproduce or distribute any content without our written consent.

8. USER-GENERATED CONTENT

If you submit content to our Site (such as reviews or testimonials), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and distribute that content for marketing purposes. You are responsible for the content you submit and represent that you have the right to grant us these rights.

9. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by the laws of the State of California. Any dispute shall be resolved through binding arbitration or litigation exclusively in the courts of Orange County, California. You consent to jurisdiction and venue in these courts.

10. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting, and we will update the Effective Date accordingly. Your continued use of our Site following modifications constitutes your acceptance of the modified Terms.
